En el presente trabajo se valora la impronta de la perspectiva deconstructiva del mal en/de/por la soberanía, en la obra de Jaques Derrida, para una crítica anti-idolátrica de la democracia. Parte del estudio crítico de dos tradiciones de fundamentación contemporánea de la democracia representativa. El examen de la propuesta de democracia deliberativa de Habermas y de la concepción de radicalización de la democracia de Ernesto Laclau, las cuales permiten evidenciar la reproducción del proceso de formalización de la democracia. Ambas critican (...) al paradigma del conflicto material de clases de origen marxista y responden con una comprensión comunicativa que parte de la centralidad del lenguaje y el discurso como práctica subjetiva consensual. A partir de la reducción del proceso subjetivo a la anterioridad preminente del discurso, la democracia deja de comprender las condiciones materiales de reproducción del sujeto corporal. Marco ante el cual valoramos el papel de la crítica al malestar de la soberanía presente en la obra de Jaques Derrida. El pensamiento derridiano en torno al Malestar de Soberanía critica la reducción de la diferencia desde una constelación categorial y metódica que implica el reconocimiento del conflicto irreductible que representa la emergencia contingencial del otro. La espectralidad como intuición comprensiva permite la afirmación de la responsabilidad ética, como base de toda posición gnoseológica, que pretenda dar condición de posibilidad a un discurso verdadero. Posición que resguarda la posibilidad transformadora del ejercicio de la soberanía a partir de develar sus procesos de represión subjetiva. Esta constelación categorial es sustantiva a una crítica de la reducción de la democracia en tanto ejercicio soberano. (shrink)

RESUMEN: Este artículo analiza la Regla de Oro de la Humanidad, que es denominador común moral de la mayoría de religiones y culturas. En primer lugar, se estudian los elementos de retribución, reciprocidad y altruismo implicados. En segundo lugar, se desarrollan algunas de las habituales críticas sobre esta Regla y dos argumentos de defensa. Finalmente, se aplica el análisis sobre esta Regla a la resolución de cuatro casos controvertidos. El objetivo de esta investigación es analizar los procesos de acreditación de programas de licenciatura en la Universidad Autónoma de Zacatecas (UAZ), para identificar áreas de oportunidad para la consolidación del proceso y de los programas. El enfoque es cualitativo, la metodología utilizada fue la revisión de documentos institucionales y la realización de entrevistas semiestructuradas a exfuncionarios, las cuales se transcribieron, codificaron y analizaron con el software ATLAS.ti. Se concluye que la consolidación de procesos de acreditación en la UAZ es (...) una utopía. Sin embargo, se identificaron áreas de oportunidad como insumo para el Proceso de Reforma Universitaria en curso. (shrink)

According to an influential view, when it comes to representing reality, some words are better suited for the job than others. This is elitism. There is reason to believe that the set of the best, or elite, words should not be redundant or arbitrary. However, we are often forced to choose between these two theoretical vices, especially in cases involving theories that seem to be mere notational variants. This is the riddle of redundancy: both redundancy and arbitrariness are vicious, but (...) there are cases in which one must be picked. Logical realists admit that there are some logical constants among the elite words. This leads to awkward questions, such as which among conjunction and disjunction is elite. In this paper, I show how the riddle of redundancy arises for logical realists, and offer a solution. This approach requires us to change how we represent negation. Instead of using some particular symbol, we represent negation by flipping formulae over the horizontal axis. (shrink)

El presente trabajo busca poner al frente y cuestionar uno de los supuestos que incorporan las formalizaciones de García de la Sienra, a saber, que las teorías han de ser reconstruidas de acuerdo con la visión semántica. Caracteriza brevemente las visiones sintáctica y semántica exponiendo el debate entre el enfoque sintáctico y el semántico. Se trata de enfoques distintos que facilitan el estudio de las teorías ante ciertos problemas filosóficos. En metafísica contemporánea, es común trabajar bajo una metodología basada en virtudes teóricas. En caso de disputa, esta metodología nos aconseja elegir la teoría que mejor satisfaga las virtudes teóricas estándar: precisión empírica, fecundidad, poder unificador, consistencia y simplicidad. Sin embargo, no hay consenso sobre cómo deben frasearse tales virtudes, ni sobre cómo ponderarlas. Aquí me concentraré en ofrecer razones a favor de una manera de frasear el principio de parsimonia ideológica, una especie de simplicidad. Defiendo que dicho principio debería (...) decir que, dadas dos teorías T1 y T2, ceteris paribus, si T1 postula menos tipos de expresiones primitvas que T2, entonces es más probable que T1 sea una teoría fiel a que T2 lo sea. Se elabora en qué consiste la cláusula ceteris paribus, qué quiere decir "postular menos tipos de expresiones primitivas" (parsimonia ideológica cualitativa) y en qué consiste la fidelidad teórica. El artículo muestra una estrategia metodológica para garantizar la dirección del proceso educativo para el desarrollo de la habilidad intelectual modelación en los estudiantes; devela sus principales fundamentos epistémicos, sus etapas y acciones esenciales. Para ello se aplicaron métodos científicos de investigación. La constatación de los resultados brinda evidencias positivas acerca de su pertinencia, al considerar el carácter coparticipativo y coprotagónico que adquieren las influencias educativas en el contexto institucional en la dirección de un proceso educativo único. The article shows (...) a methodological strategy to ensure the teaching process direction in order develop intellectual skill modeling in students; It reveals its main epistemic foundations, its stages and essential actions. That is the reason for which different research scientific methods were applied. Verification of results provides positive evidence of its pertinence when considering the collaborative nature of the educational influences within the institutional context in the direction of a unique educational process. Rare neuromuscular diseases are a group of pathologies characterized by a progressive loss of muscular strength, atrophy, fatigue, and other muscle-related symptoms, which affect quality of life levels. The low prevalence, high geographical dispersion and disability of these individuals involve difficulties in accessing health and social care services. Teleassistance is presented as a useful tool to perform psychosocial interventions in these situations. The main aim of this research is to assess the effects of a teleassistance psychosocial program on the QoL (...) levels of people with RNMDs who have different levels of disability. A sample of 73 participants was divided into an experimental group, which participated in the intervention, and a control wait list group. QoL was evaluated through the SIP and the SF-36, and disability through the WHO-DAS II. The participants with a moderate to severe level of disability were those who most benefited from the intervention. The results also revealed that the psychosocial teleassistance program was suitable to improve physical and psychosocial aspects of people suffering from a rare neuromuscular disease with a moderate level of disability, but just psychosocial aspects in those with a severe level of disability. Este trabajo intenta analizar las tensiones e interrelaciones entre el paradigma del reconocimiento y el paradigma de la redistribución. En concreto se analiza críticamente la obra de Nancy Frazer. En este sentido, se propone el paradigma de la inclusión, para un tercer ámbito, el de la política. Este paradigma se basaría en el ideal de la igual dignidad y la tricotomía inclusión/exclusión/participación. También se plantean reservas a la noción de paridad participativa, que según Fraser, hace conmensurables todas las demandas de (...) justicia. La conclusión es que redistribución y reconocimiento son irreductibles, están interrelacionados y en tensión. Para los casos de soluciones contrapuestas, se propone la noción de inconmensurabilidad que sostienen los defensores del pluralismo de valores -Berlin,Gray-. En casos de conflicto, redistribución y reconocimiento abocarían a una respuesta similar a cómo se debería resolver un dilema. (shrink)

Este artículo analiza las concepciones pluralista, deliberativa y participativa sobre la democracia que centran los debates actuales sobre el tema. Son modelos que parten de presupuestos distintos y llegan a diferentes conclusiones. Se analiza la noción de racionalidad y razonabilidad de los individuos. Y también, el concepto de egoísmo y la posibilidad del altruismo y el tránsito de la autonomía individual al autogobierno colectivo. La humildad copernicana establece que el Universo es un lugar homogéneo en el que las leyes aplican indistintamente en cualquier lugar, es decir, no existe un centro o lugar privilegiado. En ese sentido el lugar que ocupa la Tierra en el Universo es como cualquier otro, nada especial y mucho menos relacionado al favor de un Dios omnipotente cuya creación favorita sea el ser humano. Siendo esto así, sería entonces factible pensar la existencia de muchos otros planetas que como la (...) Tierra alberguen vida y sustenten civilizaciones tan o más avanzadas como la nuestra. Sin embargo, ¿por qué aún no hemos contactado con otras civilizaciones? Esto último se conoce como la paradoja de Fermi. ¿Por qué si la Tierra es solo un punto más en el Universo parece que no hay otras Tierras y otros seres inteligentes con quienes contactar? Una posible solución que intentamos discutir en el presente texto es la Hipótesis de la Tierra Rara, según la cual, en efecto, el planeta Tierra es una cosa extraordinaria en el universo. Más allá de discutir la plausibilidad de esta hipótesis frente a otras, interesa puntualizar algunos corolarios que se siguen de la misma, y su implicación para el copernicanismo desde un punto de vista filosófico. The ambiguous-cue task is composed of two-choice simultaneous discriminations involving three stimuli: positive (P), ambiguous (A) and negative (N). Two different trial types are presented: PA and NA. The ambiguous cue (A) served as an S- in PA trials, but as an S+ in NA trials. When using this procedure, it is typical to observe a less accurate performance in PA trials than in NA trials. This is called the ambiguous-cue effect. Recently, it was reported in starlings that the ambiguous-cue (...) effect decreases when the stimuli are presented on an angled (120°) panel. The hypothesis is that the angled panel facilitates that the two cues from each discrimination are perceived as a compound, precluding value transfer via a second-order conditioning mechanism. In this experiment, we used pigeons and a flat panel. Nevertheless, our data were quite similar to the previous data in starlings. We conclude that the form of the panel cannot explain the ambiguous-cue effect. Several alternatives to be explored in future experiments are suggested. The riddle of the ambiguous-cue problem still remains unsolved. (shrink)

_Introducción_: la Limitación del Esfuerzo Terapéutico (LET) busca reorientar las medidas del acompañamiento terapéutico durante el final de la vida; actualmente existe legislación sobre este tema. _Objetivo: _caracterizar el conocimiento y la claridad conceptual y jurídica del personal de salud del Hospital de San José (HSJ) de Bogotá sobre la LET. _Métodos: _estudio descriptivo transversal usando encuesta de libre preparación. Se estableció claridad conceptual con resultado superior al 70% de respuestas correctas. Datos levantados con cuestionario de selección múltiple vía Formularios (...) Google, tabulados en Microsoft Excel ® y analizados con Stata ® vía estadística descriptiva. _Resultados:_ 36 % de encuestados tuvo claridad conceptual y jurídica sobre LET; el 82,3 % de encuestados diferenciaron LET de eutanasia y el 95,6 %, LET de cuidados paliativos. El 61 % de los encuestados no tuvo conflicto moral/jurídico con LET; el 60 % y el 70 % de los encuestados creen, respectivamente, que suspender el oxígeno y la ventilación mecánica no hacen parte de la LET. Finalmente, el 78,9 % expresó no haber recibido suficiente información sobre el tema. _Conclusiones_: el personal encuestado carece de claridad conceptual suficiente sobre la LET,lo que señala la necesidad de mayor educación al respecto. Background:The first wave of the COVID-19 pandemic caused a shortage of qualified nurses in Spain. As a result, the government authorized the hiring of senior students.Objectives:To explore the ethical dilemmas and ethical conflicts experienced by final-year nursing students who worked during the first outbreak of the COVID-19 pandemic in Spain.Research design:A qualitative exploratory study was conducted using purposive sampling. Semi-structured interviews were carried out using a question guide. Interviews took place via a private video chat room platform. A thematic, inductive (...) analysis was performed of the information gathered.Participants and research context:Eighteen nursing students were recruited from two universities of Madrid, aged between 18 and 65 years old, enrolled in the fourth year of nursing studies and who were hired under a relief contract for health professionals during the pandemic.Ethical considerations:The present study was carried out in accordance with the Declaration of Helsinki, and the study was approved by the Local Ethics Committee of Universidad Rey Juan Carlos.Results:Three specific themes emerged: (a) coping with patient triage, (b) difficulties in providing end-of-life care, and (c) coping with patient death. Nursing students participated in the process of patient selection for resource allocation and ICU bed occupancy. They were shown how to care for patients who were not admitted to the ICU, in their last moments and were faced with the difficulties of applying end-of-life care. Finally, the nursing students were confronted with the death of their patients, in overwhelming numbers and under adverse conditions.Conclusions:These findings can help shed light on the ethical dilemmas and ethical conflicts faced by novice nursing students, incorporated into the workforce during the COVID-19 pandemic. Moreover, it was described that students may normalize the death due to the exhaustion and overwhelmed routine. (shrink)

Para ello, en la disciplina de los cuidados críticos se dispone de las herramientas soportadas en la evidencia, de gran valor práctico y como es obvio en el uso de elementos de diagnóstico y terapia, también con sus limitantes, como sucede con las limitaciones de valores predictivos de las mismas. Encuentro que el uso del concepto “preservar la mayoría de los años de vida”, por parte de Jakie Powder del Jhon Hopkins Center of Bioethic, se puede prestar a equívocos, pues podría entenderse como un intento de reducción de criterios utilitaristas para la asignación de recursos de ARM; el autor se hace cargo del tema e indica que “cabe aclarar que ‘preservar la mayoría de los años de vida’ no significa hacer un triage que excluya de la AMR a pacientes que sobrepasan una cierta edad, sino que no se incluya a pacientes cuya prolongación de la vida solo resulte precaria y penosa”. En el ámbito académico-filosófico de la disciplina de la bioética se encuentran en contradicción esencial dos visiones: la utilitarista materialista y la realista; es de difícil conciliación racional el intento de cuantificación objetiva de “calidad de vida”, pues ello conduciría a posibles decisiones injustas. Creo que es pertinente reconocer que el ejercicio práctico de la medicina se enmarca, generalmente -no solo en situación de pandemia- en un entorno de escasez de recursos. Estos, por supuesto, siempre han de asignarse dentro del marco de la racionalidad, la proporcionalidad terapéutica y la justicia, pero es pertinente reconocer que existen variables que determinan resultados fatales y que no pueden ser atribuibles a los procesos de decisión del clínico, quien no ha de ser obligado a lo imposible cuando el volumen y complejidad de las circunstancias de triage son apremiantes. Ello no deroga el imperativo racional hipocrático del respeto a la vida de todos como inspiración del quehacer”. Considering the case of Juan de Vilanova y Piera, often celebrated as the first scientist to accept the prehistoric antiquity of palaeolithic paintings, we explore some of the problems related to the concept of ‘precursor’ in the field of the history of science. In the first section, we propose a brief history of this notion focusing on those authors who have reflected critically on the meaning of predecessors. In the second section, the example of Vilanova illustrates the ways in which (...) historians of science have created precursors. From the vantage of modern science, precursors have traditionally been defined as those who first indicated or announced ideas or theories later accepted by the scientific community. As a result, they have been represented as ‘heroes’ struggling hard to defeat the ignorance of their time. As the case of Juan de Vilanova illustrates, this traditional view is unsatisfactory in many ways. For this reason we consider in the third section a number of methodological strategies to promote a more adequate approach to pioneers. In particular, we suggest that the best way to surmount hagiographical approaches to past scientists is to put them in their own intellectual and historical contexts. (shrink)

An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that (...) we must think of the value of epistemic states as consisting in more than simply accuracy. I develop a non-representationalist account of mathematical thought, on which the point of mathematical theorizing is to provide us with the conceptual capacity to structure and articulate information about the physical world in an epistemically useful way. On my view, accepting a mathematical theory is not a matter of having a belief about some subject matter; it is rather a matter of structuring logical space, in a sense to be made precise. This provides an elegant account of the cognitive utility (...) of mathematics. Further, it makes explicit how the brand of non-representationalism I develop is compatible with there being substantive rationality constraints on our mathematical theorizing. (shrink)

Reconstruction is a central notion in Dewey’s account of inquiry and in his metaphilosophical commitments. In his work, Dewey made a call for reconstruction of philosophy, in the reconstruction of central notions of the discipline, like knowledge, logic, truth, the good, reason, and experience. Inquiry itself is reconstructive, according to Dewey, involving the transformation of an indeterminate situation into one which is determinate and understood. Dewey’s philosophical views should therefore be of interest to those taking part in the recent turn (...) towards revisionary philosophical methodologies, like conceptual engineering, explication, and amelioration. In light of the recent developments in revisionary methodologies, I aim to explore Dewey’s conception of concepts in relation to the conceptual engineering literature, suggesting that it provides a useful conception of concepts for conceptual engineering, and to suggest a Deweyan model of philosophical inquiry where concepts are the objects of inquiry. In both cases, I hope to show a productive interaction between Dewey’s ideas and contemporary discussions of conceptual engineering. (shrink)

This analysis involves an examination of the influence of CSR image on brand identity characteristics which provide consumers with an instrument to satisfy their self-definitional needs, thereby perceiving the brand as more attractive. Also, the direct and mediated influences (through their effect on brand attitude), of CSR-based C–C identification on purchase intention are analysed. The results offer empirical evidence that CSR generates (...) more C–C identification because it improves brand prestige and distinctiveness; brand coherence is also a powerful antecedent of brand attractiveness in the context of CSR communication. Finally, CSR-based C–C identification is able to generate directly better attitude towards the brand and greater purchase intention. (shrink)

This paper argues that there are instances in which tobacco control litigation is strengthening the justiciability of the right to health and health-related rights. This is happening in different parts of the world, but in particular in Latin America. In part this is because, to a certain extent, tobacco control litigation based on fundamental rights overcomes the traditional arguments against economic, social and cultural rights adjudication: the anti-democratic argument, the lack of technical competency argument, the problem of the misallocation of (...) scarce public resources and the problem of the implementation of judicial decisions. As we analyzed in this paper, tobacco control cases based on fundamental rights are allowing courts to elaborate on broader standards of judicial adjudication of social rights, e.g., expand notions of standing, progressive realization, and state obligations enshrined in the right to health. Key to this judicial trend is the Framework Convention on Tobacco Control, which provides a legal standard — supported by scientific evidence — defining concrete measures states should take to address the tobacco epidemic, and thus giving content to the right to health as it relates to tobacco control. There is perhaps no area of law that so effectively protects human health and thereby advances the right to the highest attainable standard of health, as tobacco control. Globally, tobacco is responsible for 1 in 10 adult deaths, and is on track to kill 10 million people per year, mostly in developing countries, representing a US$200 billion drain on the global economy. Yet experience in recent decades has shown that a range of tobacco control measures, such as comprehensive bans on (...) smoking in public places, tobacco taxes, and limits on tobacco advertising, can greatly reduce smoking prevalence. These measures have slowly curtailed the epidemic, despite strong opposition from various sectors led by the tobacco industry. It is fitting that tobacco control is the focus of a recent, widely ratified global treaty and of increasing national litigation, often directly linked to countries’ human rights commitments. This paper discusses the meaning of an image rarely used within the religious and philosophical corpus of ancient India in order to describe the ultimate nature of God and the human being: a wall or canvas (Sanskrit, bhitti). The usage of such a peculiar image belongs to Abhinavagupta, the great exegete of the Tantric tradition who lived in Kashmir between the tenth and eleventh centuries A.D. After presenting some antecedents, the paper focuses on key passages taken fromAbhinavagupta’s work and shows (...) how, far from being secondary, the image of a wall possesses a remarkable consistency and expressive power in accordance withAbhinavagupta’s doctrinal presuppositions, in particular his commitment to a dynamic and ultimately paradoxical view of the divine realm, the universe and salvation. I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices.
